Terms of Service

These terms govern your use of the quiXzoom platform. Please read them carefully before using our services.

Summary: By using quiXzoom, you agree to these terms. Zoomers are independent contractors, not employees. Orderers receive data under a licence, not ownership. We prohibit illegal, harmful, or deceptive use of the platform. Violations may result in account termination.

1. Definitions

  • "Platform" — the quiXzoom website, mobile apps, APIs, and related services.
  • "Landvex AB" / "we" / "us" — the operator of quiXzoom (org. nr 559473-2437).
  • "User" / "you" — any person or entity using the Platform.
  • "Zoomer" — an independent contractor who completes photo missions for QZ Tokens.
  • "Orderer" — a person or organisation that requests and pays for photo missions.
  • "Mission" — a request for specific photos at a specific location and time.
  • "Content" — photos, metadata, text, and other materials submitted through the Platform.

2. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform. We may update these terms at any time. Continued use after changes constitutes acceptance.

3. Account Registration

To use quiXzoom, you must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access

You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Platform Agreements

Depending on how you use quiXzoom, different agreements apply:

Zoomer Agreement

As a Zoomer, you are an independent contractor, not an employee of Landvex AB or any Orderer. This means:

  • You control when, where, and how you work
  • You are responsible for your own taxes, insurance, and equipment
  • You may work for other platforms simultaneously
  • You are not entitled to employee benefits (holiday pay, sick leave, etc.)

Zoomer Obligations

  • Complete KYC/identity verification before accepting missions
  • Follow all mission instructions precisely
  • Take photos yourself — do not submit images from others or the internet
  • Ensure photos are clear, well-lit, and in focus
  • Do not trespass, break laws, or endanger yourself or others to complete a mission
  • Do not use GPS spoofing, emulators, or any tools to falsify location data
  • Maintain a rating of at least 3.5 stars to remain active

Earnings & Payouts

  • QZ Tokens are earned per approved mission
  • Tokens have no cash value until redeemed
  • Minimum payout threshold: 250 QZ
  • Payouts processed weekly to your registered account
  • Landvex AB is required to report earnings to tax authorities under DAC7 and similar regulations
  • You are solely responsible for reporting and paying taxes on your earnings

Content Licence

By submitting photos, you grant Landvex AB a non-exclusive, worldwide, royalty-free licence to use, store, and distribute the photos to the requesting Orderer. You retain copyright of your original work.

Termination

We may suspend or terminate your Zoomer account for:

  • Submitting fraudulent or manipulated photos
  • GPS spoofing or location fraud
  • Harassment or abusive behaviour
  • Consistently low quality or missed deadlines
  • Violation of any applicable laws

Orderer Agreement

As an Orderer, you request photo missions and receive verified visual data through the Platform.

Orderer Obligations

  • Provide clear, lawful, and feasible mission instructions
  • Do not request photos that violate privacy laws (e.g., inside private homes without consent)
  • Do not request photos of sensitive infrastructure for malicious purposes
  • Pay for missions promptly according to the agreed pricing
  • Review submitted photos within 7 days or they auto-approve
  • Use received data only for the stated purpose

Data Licence

Upon mission approval and payment, you receive a perpetual, non-exclusive licence to use the photos and metadata for your internal business purposes. You do not receive ownership or copyright of the images. You may not resell the photos as stock photography without a separate commercial licence.

Refunds & Disputes

  • If photos do not meet mission requirements, you may request a revision or refund within 7 days
  • Refunds are issued as QZ Tokens or original payment method, at our discretion
  • Abuse of the refund system may result in account suspension

Prohibited Uses

You may not use quiXzoom data for:

  • Stalking, harassment, or surveillance of individuals
  • Military or intelligence operations without explicit authorisation
  • Creating facial recognition databases
  • Any illegal or harmful purpose

General Platform Rules

These rules apply to all users of the Platform:

  • Do not attempt to hack, disrupt, or overload the Platform
  • Do not create multiple accounts to evade restrictions
  • Do not share your account credentials
  • Do not post hate speech, threats, or illegal content
  • Do not use the Platform to distribute malware or spam
  • Do not scrape or systematically collect data from the Platform
  • Respect intellectual property rights
  • Comply with all applicable laws in your jurisdiction

Zero Tolerance: Landvex AB has a zero-tolerance policy for harassment, discrimination, fraud, and illegal activity. Violations will result in immediate account termination and may be reported to authorities.

5. Intellectual Property

quiXzoom, the quiXzoom logo, and all platform software are the intellectual property of Landvex AB. You may not copy, modify, or distribute our software or branding without written permission.

User-submitted photos remain the copyright of the Zoomer who captured them, subject to the licence granted to Landvex AB and Orderers as described above.

6. Limitation of Liability

To the maximum extent permitted by law:

  • Landvex AB is not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid (or earned) in the 12 months preceding the claim
  • We do not guarantee uninterrupted or error-free service
  • We are not responsible for the actions of Zoomers or Orderers outside the Platform

Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence.

7. Indemnification

You agree to indemnify and hold harmless Landvex AB, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.

8. Governing Law & Disputes

These terms are governed by the laws of Sweden. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to arbitration in Stockholm under the rules of the Stockholm Chamber of Commerce.

Consumers in the EU retain any mandatory rights under local consumer protection laws that cannot be waived.

9. Termination

You may delete your account at any time through your account settings. We may suspend or terminate your account for violations of these terms. Upon termination:

  • Your access to the Platform ceases immediately
  • Unpaid QZ Token balances below the minimum threshold may be forfeited
  • Data retention follows our Privacy Policy

10. Changes to Terms

We may update these Terms of Service periodically. Material changes will be notified via email or through the Platform at least 30 days before taking effect. Your continued use after changes constitutes acceptance.
